1. Agreement to Terms

By accessing, browsing, or using the Phantom Rush Arcade website located at phantomrusharcade.com (the "Platform"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and our Cookie Policy. These documents collectively govern your relationship with Phantom Rush Arcade and your use of all services and content provided through the Platform.

If you do not agree to these Terms in their entirety, you are not authorized to use the Platform and must cease all access immediately. Your continued use of the Platform following any changes to these Terms constitutes your acceptance of those changes. 2. Eligibility

Phantom Rush Arcade is designed exclusively for adults aged 19 and older who are residents of Canada. By using the Platform, you represent and warrant that you meet both of these eligibility requirements. The age requirement of 19 years reflects the legal age of majority in the majority of Canadian provinces and territories.

We implement age verification mechanisms as part of our commitment to responsible platform operation. If we have reason to believe that a user does not meet our eligibility requirements, we reserve the right to terminate or restrict access to the Platform without notice. Misrepresentation of age or residency status constitutes a violation of these Terms and may result in immediate and permanent suspension of access.

3. Platform Description

Phantom Rush Arcade is a free social arcade entertainment platform that provides interactive digital experiences to eligible Canadian adults. Our flagship experience, Legacy of the Dead — Pharaoh's Tomb, is a social entertainment module provided by a third-party game developer and embedded on our platform for recreational purposes only.

The Platform is entirely free to use. There are no subscription fees, in-app purchases, virtual currency costs, or any other financial obligations associated with using any feature or service on Phantom Rush Arcade. The Platform does not involve financial transactions of any kind, does not offer prizes of monetary value, and does not facilitate any form of financial exchange between users or between users and the Platform. All entertainment provided through Phantom Rush Arcade is purely recreational and carries no financial risk or reward whatsoever.

4. User Conduct

As a user of Phantom Rush Arcade, you agree to conduct yourself in a manner consistent with our Community Guidelines and applicable Canadian law. Specifically, you agree not to:

• Misrepresent your age, identity, or residency status
• Use the Platform for any unlawful purpose or in violation of any applicable law
• Attempt to gain unauthorized access to any portion of the Platform, server, or connected systems
• Interfere with or disrupt the Platform's infrastructure, security features, or other users' experience
• Use automated tools, bots, scrapers, or similar technology to access or interact with the Platform
• Transmit malware, viruses, or other harmful code through the Platform
• Harass, threaten, or abuse other users or Platform staff
• Reproduce, distribute, or publicly display Platform content without authorization

Violation of these conduct standards may result in warning, temporary suspension, or permanent termination of your access to the Platform, at our sole discretion.

5. Intellectual Property

All content, features, and functionality on the Platform — including but not limited to text, graphics, logos, icons, images, audio, video, software, and the compilation thereof — are the property of Phantom Rush Arcade or its content suppliers and are protected by Canadian and international copyright, trademark, and other intellectual property laws.

The Phantom Rush Arcade name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Phantom Rush Arcade. You must not use such marks without our prior written permission. Game content, including Legacy of the Dead — Pharaoh's Tomb, remains the intellectual property of its respective developers and licensors.

6. Third-Party Content

The Platform may contain content provided by third parties, including game experiences, embedded media, and external links. Phantom Rush Arcade does not control, endorse, or assume responsibility for any third-party content. Your interaction with third-party content is governed by the respective third party's terms and policies.

Legacy of the Dead — Pharaoh's Tomb is developed and maintained by Play'n GO, a third-party game developer. We embed this experience on our Platform under applicable agreements but do not own or control the game's source code, mechanics, or visual assets. Any issues related to the game's functionality should be reported to our support team.

7. Disclaimers

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Platform will be uninterrupted, timely, secure, or error-free, or that any defects will be corrected.

We make no representations about the accuracy, reliability, completeness, or timeliness of any content on the Platform. Your use of the Platform and its content is entirely at your own risk. The disclaimers in this section apply to the fullest extent permitted by applicable Canadian law.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE CANADIAN LAW, IN NO EVENT SHALL PHANTOM RUSH ARCADE, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use of or inability to use the Platform
• Any unauthorized access to or use of our servers or any personal information stored therein
• Any interruption or cessation of transmission to or from the Platform
• Any bugs, viruses, or similar issues transmitted through the Platform by any third party
• Any errors or omissions in any content on the Platform

9. Indemnification

You agree to indemnify, defend, and hold harmless Phantom Rush Arcade, its directors, officers, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable legal fees) arising from your use of the Platform, your violation of these Terms, your violation of any rights of a third party, or your violation of any applicable law or regulation.

10. Modifications to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect by posting a notice on our homepage. What constitutes a material change will be determined at our sole discretion.

Your continued use of the Platform following the posting of revised Terms means that you accept and agree to the changes. If you do not agree to the new terms, you are no longer authorized to use the Platform.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Canada and the province in which our principal operations are based, without regard to conflict of law principles. Any dispute arising from or relating to these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts located within Canada.

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of the remaining provisions.
